Acceptance and eligibility
By downloading, accessing, or using Downsample, you agree to these terms and to the rules of the store or test program through which you got the app. If you don't agree, don't use Downsample. You must be legally able to enter this agreement.
License and acceptable use
Subject to these terms and applicable store rules, Lambda Audio gives you a personal, limited, revocable, non-exclusive, non-transferable license to use Downsample. You may connect only to servers and music you're authorized to access, and you're responsible for your server configuration, network security, and backups.
Don't use Downsample to gain unauthorized access to any system, bypass access controls, distribute unlawful material, infringe anyone's rights, introduce malicious code, probe or overload Downsample's game server or website, or reverse engineer, modify, or redistribute the app, except where applicable law expressly permits it.
Your music
Downsample plays music you choose: files you import, songs from your device's music library, music servers you connect, and the streaming catalogs the app supports. You're responsible for having the rights to the music you import or stream, including music on a server you run.
Downsample doesn't sell or distribute your music. Imported songs stay in the app's private storage on your device, and your audio isn't uploaded to Downsample's server. Song identification and chart verification send an audio fingerprint, not the audio. Lambda Audio doesn't claim ownership of your music, playlists, servers, or their metadata.
Tracks from Audius, ccMixter, and the Internet Archive come from those services under their own terms and the licenses their creators chose. Tracks included with Downsample are provided for playing in the app only.
Beta software
Beta builds may be incomplete, unstable, or incompatible with a device, music server, audio output, or operating-system update. Progress, items, currencies, and leaderboards in a beta may be reset, and beta progress may not carry over to a release. Progress is stored on your device and signing in doesn't back it up, so keep the same installation while you test. Beta features, availability, and access may change or end at any time.
Beta access and future purchases
Paid features are unlocked during the beta. The beta contains no purchase, subscription, paid trial, or automatic conversion to a paid product. Taking part doesn't by itself grant paid features after the beta.
Launch products and pricing haven't been announced. If Downsample later offers purchases, the App Store or Google Play will show the price, what you get, renewal terms if any, and cancellation information before you buy. Store rules govern billing, taxes, refunds, family sharing, and restoration. Unless we expressly say otherwise, purchases made through one platform's store don't transfer to the other platform.
In-game currencies and items
Stardust, Nova, shards, equipment, ship skins, paints, and other in-game currencies and items give you a limited license to use them in Downsample. They have no cash value, can't be exchanged for money, and can't be sold, traded, or transferred outside the app. You don't own them.
Rewards, prices, drop rates, and balance may change. We may adjust, reset, or remove currencies and items, for example to fix an error, respond to cheating, or during the beta. Except where the law requires otherwise, currencies and items aren't refundable; refunds for store purchases follow the store's rules.
Online play, leaderboards, and conduct
Online features include leaderboards, Galaxy standings and dossiers, pilot ratings, ghosts, friends, rival challenges, and community charts. Your display name, player tag, emblem, scores, and standings are public.
- Choose a display name and emblem that isn't hateful, harassing, sexually explicit, impersonating, or someone else's private information.
- Don't cheat. That includes modified apps, automation, exploiting bugs for scores or rewards, submitting runs you didn't play, and manipulating leaderboards, ratings, votes, or reports.
- Don't harass, threaten, or spam other players through challenges or friend requests.
Scores and runs may be checked. We may remove scores or runs, reset display names or emblems, hide community charts, or restrict online features for anyone who breaks these rules. Community charts that receive enough reports can be hidden automatically.
To report a player, use Report player on the Friends or Leaderboards screen. Blocking a player removes the friendship, closes pending challenges, and stops future friend requests and rival challenges from them. Public standings may still show that player.
Third-party services
Downsample works with independently operated music servers, streaming catalogs, sign-in providers, stores, and purchase infrastructure. Their availability, behavior, security, and terms are outside Lambda Audio's control. Naming a compatible service doesn't imply endorsement, sponsorship, or affiliation. You're responsible for any charges, permissions, and terms that come with services you choose.
Ownership and feedback
Downsample and its software, artwork, ships, design, branding, and documentation are owned by Lambda Audio or its licensors and protected by intellectual-property laws. These terms don't transfer ownership of the app to you.
If you send feedback or suggestions, then unless a separate written offer says otherwise, you give Lambda Audio a worldwide, perpetual, irrevocable, royalty-free, non-exclusive license to use, modify, and incorporate that feedback without compensation or attribution. This doesn't give us rights to your music or to confidential material, which you shouldn't include in feedback.
Privacy
The Privacy Policy explains how Downsample handles information. When you use third-party servers or services, you also direct information to their operators under their own policies.
No warranty and limitation of liability
To the maximum extent allowed by law, Downsample is provided “as is” and “as available,” without warranties of uninterrupted operation, compatibility, merchantability, fitness for a particular purpose, or non-infringement. To the maximum extent allowed by law, Lambda Audio and its contributors aren't liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of data, progress, items, access, revenue, or use arising from Downsample.
Nothing in these terms excludes warranties, remedies, consumer rights, or liability that can't legally be excluded or limited. Some jurisdictions don't allow particular exclusions, so parts of this section may not apply to you.
Changes, suspension, and termination
Features and these terms may change as Downsample evolves. Material changes to these terms will be dated here and, when appropriate, mentioned in the app or release notes. Changes apply going forward.
You can stop using Downsample at any time, and delete your online account under Settings › Account & Language › Session and account data › Delete Online Account & Data. We may suspend or end your access to online features, the beta, or support if you break these terms, when reasonably necessary to protect players or systems, or to comply with law or store obligations. Sections that by their nature should survive termination will survive.
Applicable law and disputes
These terms don't take away mandatory protections under the law where you live. Before filing a claim, please email support@downsample.app so we can try to resolve it informally. Any unresolved dispute may be brought in a court with jurisdiction under applicable law. Nothing here prevents either party from seeking urgent protective relief where available.
General terms
These terms and the Privacy Policy are the entire agreement about the services they cover, subject to mandatory store terms. If one provision is unenforceable, the rest remain effective. A failure to enforce a provision isn't a waiver. You may not assign these terms without Lambda Audio's consent; Lambda Audio may assign them as part of a reorganization, financing, or transfer of Downsample, subject to applicable law.
Store-specific terms and contact
On Apple platforms, Apple's Standard EULA applies in addition to these terms where required. On Android, the Google Play Terms of Service apply to the store. A store's mandatory terms control if they conflict with these terms. Use the support page or email support@downsample.app with questions.
